These Terms and Conditions (“Terms”) govern your use of sugarhillfarmpa.com (the “Site”) and any order you place with Sugar Hill Farm LLC (“Sugar Hill Farm,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Who Can Use This Site
You must be at least 18 years old to place an order with Sugar Hill Farm. By ordering, you confirm that you meet this requirement and have the legal capacity to enter into a binding agreement.
2. Orders & Pricing
All orders are subject to product availability, as described in our Shipping Policy. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or issues with availability.
While we work to keep pricing accurate, errors can occasionally occur. If a product is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund, even if the order has already been confirmed.
3. Order Changes & Cancellations
You may cancel or change your order at any time before it has shipped. Once an order has entered processing for shipment, we may not be able to make changes. To cancel or modify an order, contact us as soon as possible through our Contact page.
4. Returns & Refunds
Because our products are perishable, frozen food items, we’re unable to accept returns for change-of-mind, incorrect selection, or similar reasons once an order has shipped.
If your order arrives damaged or thawed, that’s covered separately under our Shipping Policy, contact us within 48 hours with photos and we’ll send a replacement at no cost to you.
5. Bulk & Custom Orders
Quarter and half beef orders are subject to the separate process described in our Shipping Policy, including deposits, processing fees paid directly to our butcher partner, and pickup arrangements. These terms apply in addition to the general terms on this page.
6. Your Conduct on This Site
When using our Site, you agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to our systems or another user’s account
- Submit false, misleading, or fraudulent order or payment information
- Interfere with the proper functioning of the Site
7. Reviews & Submitted Content
If you submit a review, testimonial, or other content to us, you grant Sugar Hill Farm a non-exclusive, royalty-free right to use, reproduce, and display that content in connection with promoting our products, including on the Site and our social media. You’re responsible for making sure anything you submit is truthful and doesn’t infringe on anyone else’s rights.
8. Intellectual Property
All content on this Site, including text, images, logos, and recipes, is the property of Sugar Hill Farm LLC unless otherwise noted, and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content for commercial purposes without our written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Sugar Hill Farm LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or your purchase of our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.
Nothing in these Terms limits any rights you have that cannot be waived under applicable law.
10. Dispute Resolution & Binding Arbitration
You and Sugar Hill Farm LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any order shall be resolved through binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
- Arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules.
- Arbitration will take place in Elk County, Pennsylvania, or another mutually agreed location, or may be conducted remotely/by document submission where permitted.
- You and Sugar Hill Farm LLC each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
- The arbitrator’s decision will be final and binding, subject to any limited review available under applicable arbitration law.
This section does not prevent either party from seeking injunctive relief in court for issues like intellectual property infringement.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles, except where superseded by the arbitration terms above.
12. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” at the top of this page reflects the most recent version. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
